1. Service Description

1.1 What We Provide

EvaluationCat provides a SaaS platform that enables enterprises to perform information security self-assessments and vendor (supply chain) security assessments based on ISO 27001/27002 and related standards, generate assessment reports, and download remediation guidance and compliance policy templates. The Service is a digital software-as-a-service (SaaS) product delivered over the internet.

1.2 Digital Nature of the Service

The Service consists of digital, intangible products. Access to the Service (including assessment reports and downloadable materials) is enabled immediately upon confirmation of payment. Due to the instant-delivery nature of digital services, refunds are subject to specific limitations as described in our Refund Policy (Section 5).

2. Account Registration and Security

2.1 Account Creation

Use of this Service requires creating an account with accurate and complete information. All accounts are obtained through user self-registration, and the account holder is the "Registered User". You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account, even if unauthorized by you.

2.2 Account Security

• If you discover that your account, password, or other access credentials have been leaked, lost, or stolen, or believe an unauthorized individual is using your account, notify us immediately at support@evaluationcat.com.
• Do not share your login credentials with any third party. The account shall not be used for purposes other than this Agreement.
• Keep the email address associated with your billing account valid and up to date.

2.3 Enterprise Accounts

If you register on behalf of a company or organization, you represent and warrant that you are authorized to bind that entity to this Agreement. We reserve the right to restrict, suspend, or terminate accounts that violate these Terms.

3. Plans, Billing, and Payment

3.1 Plans and Pricing

We offer free and paid plans (including one-time Pro purchases and annual Enterprise plans). Current plan details and pricing are displayed on the upgrade page within the Service. We reserve the right to modify plan features or introduce new plans at any time; price changes apply to future purchases only and will not retroactively affect purchases already made.

3.2 Payment Authorization

Each purchase is a one-time transaction. By completing checkout, you authorize us to charge your selected payment method the amount displayed at checkout. Plans do not automatically renew — annual plans remain valid for 12 months from the date of purchase, and continued use after expiry requires an explicit new purchase at then-current prices.

3.3 Taxes

Unless otherwise stated, listed prices do not include applicable taxes (including VAT, GST, or sales tax). Where required by applicable law, such taxes will be collected and remitted accordingly.

4. Refund Policy

Due to the digital nature of our services (SaaS / digital reports), refunds are generally not provided once the service has been delivered or a report has been generated. Refunds may be granted in exceptional circumstances — such as duplicate payments caused by billing errors, system failure preventing report generation after successful payment, or verified prolonged service interruption attributable to us. Your statutory rights (including any cooling-off rights under applicable law) are preserved.

Refund requests must be submitted within 7 days of purchase to support@evaluationcat.com with your Order ID, payment date, and a description of the issue. Full details are available in our Refund Policy.

5. Cancellation and Account Deletion

You may delete your account at any time by contacting us at support@evaluationcat.com from your registered email address. Account deletion requests are processed within 15 working days. After deletion, your account data will be retained for up to 90 days for backup, dispute resolution, and legal compliance purposes, and will then be deleted or anonymized in accordance with our Privacy Policy. Because plans do not automatically renew, no further cancellation action is required to stop future billing.

6. Billing Disputes

If you believe a charge is incorrect, please contact us at support@evaluationcat.com before initiating a dispute with your bank or card issuer. We commit to responding within 2 business days and resolving confirmed billing errors within 5 business days, with eligible refunds issued to your original payment method.

7. Copyright and Intellectual Property

All services and content of the Evaluation Cat platform — including but not limited to software, databases, assessment standards, assessment templates, regulation decomposition mappings, industry benchmarking data, and other information materials — are protected by the Copyright Law, Trademark Law, and Patent Law of the People's Republic of China and other applicable laws, regulations, and international treaties.

The materials provided by this Service are for your internal management and reference purposes only. Without our prior written authorization, no one may reprint, excerpt, forward, publish, or commercially exploit the platform content, nor use hyperlinks, transmission, storage, or "mirror links" to load it into other information retrieval systems, servers, or websites. Authorized users may browse, download, or export a limited amount of materials for their own internal use.

Compliance references such as laws, regulations, and standards cited in this Service include links to the original texts, and the relevant content is subject to the original source. The intellectual property rights of data and materials (such as regulations, policies, and files) uploaded and stored by users through this Service belong to the original authors, and you retain ownership of your assessment input and generated report data.

It is strictly forbidden to access our computer system without authorization, or to reverse engineer or decompile the software, for any reason.

8. Acceptable Use

You may use this Service only for lawful purposes consistent with these Terms, including internal compliance management, security assessment, and research activities. You agree not to:

• Upload or distribute content that is illegal or infringes on the legitimate rights of others (including but not limited to state secrets or security, ethnic or religious discrimination, obscene, pornographic, or intimidating information);
• Use the Service to infringe any third party's intellectual property or privacy rights;
• Create malware, phishing content, or network attack tools, or interfere with or bypass the security features of the Service;
• Use web crawlers or other automated programs to systematically extract the content of this Service or obtain others' personal information for any purpose;
• Automatically extract or compile albums, compilations, databases, or directories from the Service;
• Resell or sublicense access to the Service without our prior written approval;
• Provide assessment invitations to vendors without obtaining the vendor's authorization;
• Violate any applicable law, regulation, or card network rules.

If any infringement risk or dispute arises due to your violation of the foregoing provisions, the relevant adverse consequences shall be borne solely by you, and you shall compensate us for all direct and indirect losses we suffer as a result.

9. Data, Privacy, and Security

Your use of the Service is subject to our Privacy Policy. Personal information collected in the course of registration and use (such as name, contact email, and company information) is processed in accordance with that policy. Unless otherwise provided by laws and regulations, we will not share your information with any third party without your permission.

Payment card data is processed exclusively by our PCI-DSS compliant payment processors (including Waffo Pancake, Creem, Alipay, and WeChat Pay, depending on the payment method you choose) and is never stored on our servers. 10. Disclaimers and Limitation of Liability

10.1 Disclaimers

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or accuracy of assessment output. The compliance information provided is compiled based on ISO 27001/27002 standards and publicly available content for retrieval convenience; we do not guarantee the accuracy, validity, or completeness of any information provided, and you have the obligation to review it before formal use.

⚠️ Assessment Output Disclaimer: The assessment tools provided by this Service and any data formed during the service process cannot be regarded as legal opinions or audit reports with legal effect, nor as a basis for determining whether activities in your business operations comply with laws and regulations. Always verify critical results with qualified professionals before relying on them.

10.2 Limitation of Liability

To the maximum extent permitted by applicable law, EvaluationCat shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to losses caused by computer viruses or other malicious software, system failures, or the acts, negligence, or faults of third parties. Our total aggregate liability arising out of or relating to the Service shall not exceed the amount you paid to us in the 12 months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

11. Term and Termination

These Terms remain in effect for as long as you use the Service. We may suspend or terminate your account if you materially breach these Terms, engage in suspected fraud, or where required by law. If we terminate the Service for reasons other than your breach, we will refund the pro-rata unused portion of any prepaid period. You may delete your account at any time by contacting support@evaluationcat.com.

12. Governing Law and Dispute Resolution

The conclusion, effectiveness, performance, interpretation, and dispute resolution of this Agreement shall be governed by the laws of the People's Republic of China. If any dispute arises between you and us, both parties shall first attempt to resolve it through friendly negotiation; if negotiation fails, either party may file a lawsuit with a competent People's Court in accordance with the law.

13. Changes to These Terms

We may modify these Terms from time to time. For material changes, we will provide at least 14 days advance notice via email or in-product notice before the effective date, and publish the updated version on this page. Continued use of the Service after the effective date constitutes acceptance of the revised Terms. If any provision of these Terms is held invalid, the remaining provisions continue in full force. These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and us regarding the Service.
